Article V. Substitution

Outlines rules, conditions, and procedures for valid candidate substitution during the election period.

Section 1.

Save in case of a valid substitution as where a candidate withdrew, died, or has been declared disqualified, candidates are not permitted to change positions and parties after the period for the filing of the Certificate of Candidacy.

Section 2.

No substitutions due to withdrawal shall be allowed before the start of the official campaign period. In general, the requisites for a valid substitution due to withdrawal are:

  1. There must be an official candidate of a registered or accredited political party.
  2. The official candidate must have withdrawn his/her Certificate of Candidacy (COC) before the start of the official campaign period.
  3. The substitute candidate must belong to, and be certified by, the same political party of the official candidate who has withdrawn his/her COC; and
  4. The substitute candidate must have filed his/her COC and a Certificate of Nomination and Acceptance for the office affected before the start of the official campaign period.
  5. Official announcement of the approved substitute candidates will be posted after the completion and approval of the said requirements.
Section 3.

No substitute shall be allowed for any independent candidate.
